TERMS & CONDITIONS

Last Updated: October 2, 2026

These Terms & Conditions (“Terms”) govern your access to and use of biltfitnessstudio.com (the “Website”), your purchase or use of BILT Fitness Studio classes, memberships, class packages, merchandise, events, and other services, and your participation in activities offered by BILT Fitness Studio (“BILT,” “we,” “us,” or “our”). By using our Website, creating an account, booking a class, purchasing a membership or class package, attending a class, or otherwise using our services, you agree to these Terms.

1. About BILT Fitness Studio+

BILT Fitness Studio is a boutique fitness studio located in Rexburg, Idaho. We provide high-intensity, low-impact reformer-based fitness classes and related fitness services. BILT is not a medical provider, physical therapy provider, rehabilitation facility, or healthcare provider.

2. Eligibility to Participate+

You are responsible for determining whether you are physically able to participate in BILT classes. You should consult a qualified healthcare professional before participating if you are pregnant, have recently undergone surgery, have an injury or medical condition, have been advised to limit physical activity, or are unsure whether a particular activity is appropriate for you. You are responsible for informing your instructor of any relevant injury, pregnancy, limitation, restriction, or condition that may require modifications.

3. Assumption of Risk+

Physical exercise involves inherent risks. BILT classes may include resistance training, repetitive movement, balance work, muscular fatigue, cardiovascular exertion, stretching, spring-loaded or resistance-based equipment, and transitions on and around reformer equipment. Possible risks include soreness, strains, sprains, falls, loss of balance, overexertion, equipment-related injury, and other injuries associated with physical activity. By participating, you voluntarily assume the ordinary and inherent risks associated with physical exercise and fitness activities.

Participation may also be subject to a separate waiver, release of liability, or acknowledgment completed during booking, registration, or check-in. If a separate waiver is presented to you, that waiver is incorporated into your agreement with BILT.

4. Instructor Guidance and Personal Responsibility+

You are responsible for exercising within your own abilities and limitations. Stop exercising and notify your instructor if you experience dizziness, chest pain, unusual shortness of breath, severe discomfort, sharp pain, loss of balance, or any symptom that causes concern. BILT instructors may provide general fitness instruction and modifications, but you remain responsible for determining whether you are comfortable continuing a movement.

5. Class Reservations+

Class availability is limited and reservations may be required in advance. Because BILT operates with a limited number of reformers, booking a class reserves a specific space that may otherwise have been available to another client. BILT may establish reservation, cancellation, waitlist, no-show, and late-arrival policies. Policies disclosed at booking are incorporated into these Terms.

6. Class Schedule Changes+

Class schedules, instructors, formats, operating hours, and availability may change. BILT may modify class times, substitute instructors, cancel classes, adjust capacity, temporarily close the studio, or change programming. When reasonably possible, we will attempt to notify affected customers of significant changes.

7. Late Arrivals+

For safety and to avoid disrupting class, late entry may be restricted. Clients are encouraged to arrive early enough to check in, prepare their reformer, and receive any necessary instruction. First-time clients are asked to arrive approximately 10 minutes before class. If you arrive after class has started, BILT or the instructor may determine that participation is no longer appropriate.

8. Grip Socks+

Grip socks are required for BILT classes to support safe use of the equipment and studio hygiene. Clients may bring their own appropriate grip socks or purchase a pair at the studio.

9. First Class Free Offer+

BILT may offer a complimentary first class to eligible new clients. Unless otherwise stated, the offer is limited to one complimentary class per person, has no cash value, may not be combined with other promotions, and may be modified or discontinued at any time. Creating multiple accounts or using different contact information to receive multiple free classes is prohibited.

10. Class Packages+

Class packages may have expiration dates, usage limitations, or other conditions disclosed at purchase. Unless otherwise stated, class packages are for individual use, may not be transferred or resold, and have no cash value. Unused classes are not redeemable for cash and may be forfeited when a package expires unless otherwise required by law or specifically approved by BILT.

11. Memberships+

BILT may offer monthly, unlimited, or other recurring memberships. Specific terms may include billing frequency, renewal terms, cancellation requirements, commitment periods, pause or freeze rules, usage restrictions, reservation limits, and no-show policies. Any membership terms disclosed at checkout or enrollment are incorporated into these Terms.

Automatic Renewal

If you purchase an automatically renewing membership, the renewal frequency, price, and cancellation terms will be disclosed at or before purchase. By enrolling, you authorize BILT or its payment provider to charge the applicable payment method according to the disclosed billing schedule until the membership is canceled in accordance with the applicable cancellation terms.

12. Prices and Promotions+

Prices are subject to change and generally apply to future purchases. We may offer introductory, student, promotional, partner, referral, or limited-time pricing. Promotional pricing does not create an entitlement to future discounts.

13. Payments+

You agree to provide accurate payment information and authorize applicable charges when purchasing BILT services. Payments may be processed by third-party payment processors. If a payment fails, BILT may request updated payment information, suspend booking privileges or a membership, cancel a reservation, or attempt to process the payment again where permitted.

14. Refunds+

Unless otherwise stated at purchase, class packages, memberships, and other fitness services are generally non-refundable once purchased. BILT may provide refunds, credits, extensions, or other accommodations at its discretion. Nothing in this section limits refund rights that cannot legally be waived.

15. Cancellations and No-Shows+

Because classes have limited capacity, timely cancellations are important. Cancellation deadlines, late-cancellation consequences, and no-show policies may be displayed in the booking platform or reservation process. If you cancel outside the permitted window or fail to attend a reserved class, BILT may deduct the class from your package, treat the reservation as used, charge an applicable fee, or restrict future reservations in cases of repeated abuse.

16. Waitlists+

BILT may use waitlists for full classes. If a space becomes available, customers may be added automatically or notified through the booking system. If you join a waitlist, you are responsible for monitoring notifications and understanding the applicable waitlist rules.

17. Studio Conduct+
  • Follow instructor directions and posted safety rules.
  • Treat instructors, staff, and other clients respectfully.
  • Use equipment properly and only for its intended purpose.
  • Avoid disruptive, threatening, harassing, or inappropriate behavior.
  • Respect the studio, surrounding property, and other clients’ privacy.
  • Do not attend while impaired by alcohol or drugs.

BILT may refuse service, remove a participant from class, suspend an account, or terminate a membership if conduct threatens safety, disrupts the studio environment, damages property, or materially violates these Terms.

18. Equipment+

BILT equipment must be used only as instructed. Clients may not alter equipment, make unsafe adjustments, remove equipment from the studio, or intentionally damage equipment. Clients may be responsible for damage caused by intentional misuse, reckless conduct, or unauthorized use.

19. Personal Property+

You are responsible for your personal belongings. To the fullest extent permitted by law, BILT is not responsible for lost, stolen, damaged, or misplaced personal property.

20. Pregnancy+

Many individuals may continue exercising during pregnancy with appropriate guidance and modifications, but each pregnancy and individual is different. Pregnant participants should consult their healthcare provider regarding exercise and inform their BILT instructor before class so appropriate modifications can be considered. BILT instructors do not provide medical advice.

21. Minors+

BILT may establish age requirements for participation. If a minor is permitted to participate, BILT may require consent from a parent or legal guardian and may require a waiver or related documentation to be completed on the minor’s behalf.

22. Photography and Video+

BILT may occasionally take photographs or videos in the studio for promotional, educational, or social-media purposes. Where appropriate, we may request consent before using identifiable images of clients for advertising or promotional purposes. Clients may take reasonable photos or videos of themselves where doing so does not interfere with class, create a safety issue, or invade another person’s privacy.

23. Reviews and Testimonials+

Clients may voluntarily submit reviews, testimonials, comments, photographs, videos, or other feedback. If you submit content directly to BILT for promotional use, you represent that you have the right to provide it and that it does not violate another person’s rights. BILT does not require positive reviews as a condition of receiving ordinary studio services.

24. Social Media+

If you tag BILT, mention BILT, or interact publicly with BILT’s social-media accounts, we may like, share, repost, or respond to publicly available content where appropriate. Your use of a social-media platform is also governed by that platform’s own terms and privacy practices.

25. Website Use+

You may use the Website only for lawful purposes. You may not attempt to interfere with Website operation, gain unauthorized access, upload malicious code, scrape or overload the Website through automated systems, impersonate another person, submit fraudulent information, or use Website content for unauthorized commercial purposes.

26. Intellectual Property+

The Website and BILT materials may include logos, photography, videos, graphics, written content, class descriptions, branding, layouts, and promotional materials owned by BILT or used with permission. You may view and use Website materials for ordinary personal purposes, but may not copy, reproduce, distribute, modify, sell, commercially exploit, or create derivative works from BILT materials without authorization.

27. BILT Branding+

“BILT Fitness Studio,” BILT logos, branding elements, slogans, and other identifiers may be protected trademarks, trade names, or other intellectual property. Nothing on the Website grants permission to use BILT branding for commercial purposes without written authorization.

28. Third-Party Services+

BILT may use third-party providers for scheduling, payment processing, website hosting, email, text messaging, analytics, maps, social media, and other operational services. Those providers may have separate terms and privacy policies. BILT does not control all functionality, availability, or policies of independent third-party providers.

29. Third-Party Links+

The Website may contain links to third-party websites. A link does not necessarily mean BILT endorses or controls the linked website. You access third-party websites at your own discretion and subject to their terms.

30. Website Availability+

We aim to keep the Website available and accurate but do not guarantee uninterrupted access. The Website may be unavailable because of maintenance, technical problems, internet interruptions, third-party outages, updates, or events outside our control.

31. Accuracy of Information+

We make reasonable efforts to provide accurate information, but typographical errors, outdated information, pricing errors, scheduling errors, or other inaccuracies may occur. BILT reserves the right to correct errors and update information.

32. No Medical Advice+

Information provided by BILT, its Website, instructors, social-media accounts, or other materials is intended for general fitness and educational purposes only. It is not medical advice and should not be used to diagnose, treat, prevent, or cure a medical condition.

33. Results Are Not Guaranteed+

Individual fitness results vary based on factors including participation frequency, diet, sleep, genetics, exercise history, lifestyle, consistency, and health status. BILT does not guarantee any particular physical, aesthetic, athletic, weight-loss, strength, or health result.

34. Disclaimer of Warranties+

To the fullest extent permitted by law, the Website and BILT services are provided on an “as available” and “as is” basis. BILT does not guarantee uninterrupted Website operation, specific fitness outcomes, or availability of any particular instructor, class, or schedule. Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

35. Limitation of Liability+

To the fullest extent permitted by applicable law, BILT Fitness Studio and its owners, employees, instructors, contractors, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from use of the Website or services. Nothing in these Terms is intended to exclude or limit liability where prohibited by law. Any separate liability waiver or assumption-of-risk agreement executed by you remains independently applicable according to its terms.

36. Indemnification+

To the extent permitted by law, you agree to indemnify and hold BILT harmless from claims, damages, liabilities, losses, or expenses arising from your unlawful use of the Website, material violation of these Terms, intentional misconduct, or infringement of another person’s rights. This provision does not require you to indemnify BILT for liability that cannot legally be shifted to you.

37. Suspension or Termination+

BILT may suspend or terminate access to services where reasonably necessary because of repeated policy violations, fraudulent activity, unsafe behavior, harassment, nonpayment, abuse of promotions, misuse of the booking system, or serious disruption of studio operations. Termination does not eliminate payment obligations properly incurred before termination.

38. Governing Law+

These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles, except where federal law or another mandatory law applies. Legal proceedings relating to these Terms may be brought in a court of competent jurisdiction in Idaho unless applicable law requires otherwise.

39. Changes to These Terms+

BILT may update these Terms periodically. Material changes may be communicated through the Website, email, booking system, or another reasonable method where appropriate. Continued use of the Website or services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

40. Severability+

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect. The invalid provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally permitted.

41. No Waiver+

If BILT does not enforce a provision of these Terms on one occasion, that does not mean we waive the right to enforce it later.

42. Entire Agreement+

These Terms, together with our Privacy Policy, booking terms, membership terms, waivers, releases, and other agreements presented in connection with a purchase or participation in BILT services, form the agreement governing your relationship with BILT. If a specific membership agreement, waiver, or checkout term conflicts with these general Terms regarding that particular service, the more specific agreement controls.
